A. Conditions for use of the Sena website - General
1. Alteration of the ConditionsThe Collecting society for neighbouring rights (hereinafter: Sena) reserves the right to alter or adjust the Conditions unilaterally. Your use of the Site after an adjustment of the Conditions implies that you agree to the altered Conditions. Sena may adjust the contents of the Site and remove or add components. Some applications on Sena’s Site contain special conditions for use. Those special conditions may determine that they take precedence over these Conditions. The most recent adjustment of these Conditions was on 10 July 2003.
2. Rights of intellectual property
The copyrights and other intellectual proprietary rights with respect to the texts, illustrations and other protected materials on the Site are vested in Sena or the rightholders of those materials respectively. In no way will the rights referred to above pass to persons who gain access to this Site.
3. Permitted use
You are only permitted to download a copy of the material made available on the Site for your own, non-commercial use, unless expressly stated otherwise on the Site. It is permitted, however, to copy the forms and remunerations included on the Site, and use them for the purpose they are intended for by virtue of their conditions. Without Sena’s prior written consent you are not permitted to otherwise copy, alter, distribute, circulate or use in any other manner the materials made available. Framing (components) of the Site is not permitted without Sena’s written consent. Hyperlinking is permitted, provided Sena is informed of the fact.
4. Liability
Although the information offered on this Site is carefully composed and maintained by Sena, Sena cannot guarantee that the information is complete and correct. Therefore Sena accepts no liability for any consequences, such as damages or lost profits, as a result of the use, the trust in or actions undertaken on the basis of information on this Site. Sena is not in any case liable for errors and interruptions in the functioning of the Site. The information offered is not intended as a replacement for expert advice. If you make use of the information offered without verification or further advice, you will do this at your own expense and risk. You yourself are fully responsible for all the information you supply to us. References to sites that are not maintained by Sena have merely been included for the information of the visitor. Although Sena acts selectively with respect to the sites referred to, Sena cannot vouch for the contents and the functioning of those sites. Sena expressly rejects any liability in this respect.
5. Privacy statement
Unless otherwise stated on the Site, the personal data you enter on the Site will exclusively be used for Sena’s usual tasks and activities. These data will not be passed on to third parties, unless in connection with Sena’s tasks and activities. For further information see the Privacy Statement (C) at the bottom of this page.
6. Applicable law
Sena is a foundation under the law of The Netherlands. By visiting Sena’s Site you agree to the application of Dutch law and to the assessment of comments, complaints and the like concerning the Site by judges in The Netherlands.
B. Use of the ‘MySena’ applications by Sena’s rightholders
1. IntroductionThe Conditions mentioned above are applicable, in so far as they are not expressly deviated from hereafter. The information on the Site component referred to here (hereafter: MySena) is exclusively accessible to Sena rightholders who received a password from Sena at their own request. In order to be able to make use of the MySena applications, the rightholder must dispose of a personal Sena-number and to request a personal password from Sena through a letter or e-mail message in advance. MySena was made fit for communication of personal data which are linked to a specific rightholder by means of a personal combination of the Sena-number and Password. Not all browsers are capable of showing the MySena applications completely. In order to be able to use all the functionalities a rightholder must dispose of a version of Internet Explorer or Netscape as recommended in the login screen of the MySena applications.
2. Security, requesting a personal password
In order to prevent unauthorized persons from gaining access to personal and confidential information, a rightholder who requests this personally with Sena through a letter or e-mail message will subsequently be sent a personal Password. The MySena applications are not accessible until the combination of the personal Sena-number and password has been entered through the MySena login screen. It makes sense to save your personal Password carefully. The personal Sena-number and the personal Password must be kept an absolute secret. The rightholder with a personal Password guarantees Sena that his/her Password will not be used by unauthorised persons. In case of a suspicion that the personal Sena-number and Password is or may be known to a third party, the rightholder must inform Sena without delay, preferably through an e-mail message to: mremkes@sena.nl
In that case Sena will adjust the list of Passwords by changing the Password. Normally this will be done on working days, within 24 hours after Sena has been warned. Adjustments are not made during weekends. A new Password will be forwarded through e-mail as soon as possible. In the same way the rightholder can request a new Password if he/she has forgotten their Password.
3. Confidentiality of data
For data traffic of all confidential, personal information - such as login, requesting specified statements of payments and the like - through MySena the chance of people looking or listening in is reduced to a minimum by means of the use of a secure environment. Besides, all rightholders must identify themselves by entering the personal Sena-number and Password before confidential data can de retrieved.
4. Liability
Requesting a personal Password means that the rightholder wishes to make his/her personal data accessible through MySena at his/her own expense and risk through the personal Sena-number and Password, in the way they are made available by Sena. Rightholder is liable for the consequences of any unauthorised use, misuse or incorrect use of the personal Sena-number and/or Password. Sena is neither liable for any damages ensuing from assigning personal Passwords and sending them by e-mail, nor for any use made of them whatsoever. Neither is Sena liable for any damages ensuing from the linking of personal Sena-numbers and Passwords to data, or from any use thereof whatsoever, or the impossibility thereof, of MySena applications.
5. Specified statements of payments
No rights whatsoever can be derived from the specified statements of payments on MySena. Exclusively the administrative data issued by Sena and the written specified statements of payments sent by Sena on the basis of those data are of legal value.
C. Privacy Statement
In case of a visit to this website, the Collecting society for neighbouring rights (hereafter: Sena) can process data submitted by you. For instance, data you entered through questionnaires or somewhere else on the website, could be used for this purpose. Also, within the framework of these processings does Sena guarantee your privacy, among other things by complying with the Personal Data Protection Act. Where your personal data are processed, you will find exactly described which data are used to what ends. Your personal data will only be used for the purpose you intended when you left them. This means that if you entered your name and address in order to receive a particular brochure, for instance, these data will not be used to send you other brochures as well (except when this was indicated). This also means that your data will not be used for other purposes, such as forwarding press releases, for instance. Data can be used for investigations, however, if offences are committed or punishable remarks made through the Site (and other exceptions such as mentioned in article 43 of the Personal Data Protection Act). Personal data are not kept beyond the time they are required to serve the purpose the data were requested for. For all processings of personal data the rule applies that only the data you actively left behind yourself will be used. In case so-called information profiles are maintained, they are exclusively used to improve the tuning of the website to the requirements of the user, and you will be informed of this in advance. The Personal Data Protection Act
The Personal Data Protection Act (Wbp) will be complied with when processing personal data. This Act helps protect the privacy of citizens. The Wbp applies among other things to data which are processed through Sena’s website. This means that personal data which are collected, saved, used, or made available in any other shape or form, are connected with each other, as well as screened off through the internet, fall under this Act as well. By virtue of the Wbp the person involved must be informed before personal data are processed, and the purpose for which they are collected must be communicated as well (article 33). Consequently personal data will only be processed after this has been expressly announced and when the reason for which the data are saved has been stated.
Personal data
A personal detail is understood to mean a piece of information which can be traced back to an ‘identified or identifiable natural person’. This means that the name of a person to which the data are related is either known, or that person can be traced. An example of a personal detail is a name of a person or a private address, but e-mail addresses may be personal data as well.
Data processing
Sena collects and processes information related to rightholders (creators of music) and parties liable to pay (users of music) in connection with an efficient and effective management. The information made available through this website by you as a rightholder can also be used to inform you of possible changes with respect to the use of the MySena applications. It goes without saying that your personal data will neither be sold nor made available to third parties.
Cookies
In order to make this website function better and faster and to be able to tune it to your preferences, certain information concerning your use of this website is collected. This information can be collected by making use of so-called ‘cookies’. They are small text files that are automatically placed on your computer by the webpage visited. Through the settings of your browser you stop the use of cookies.
